This Policy describes the privacy practices for Total Golf Resources, Golf Payments, Total Golf 18, the totalgolf18.com web site and various related services (collectively referred to as the Site). Total Golf Resources, LLC, the provider of the Site, is committed to protecting your privacy online. Please read the information below regarding your use of the Site.

We protect your personal information.

We implement a variety of security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. When you place orders or access your personal information, we offer the use of a secure server. All sensitive/credit information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted to be only accessed as stated above.

We do not sell or trade your information to anyone.

The term "affiliated parties" includes third parties who assist us in hosting or assisting us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.

We reserve the right to change this Privacy Policy from time to time without notice to you. You acknowledge and agree that it is your responsibility to review this site and this Privacy Policy periodically and to be aware of any modifications. Your continued use of this site after such modifications will constitute your acknowledgment of the modified Privacy Policy and agreement to abide and be bound by the modified Privacy Policy.

Privacy Policy Details.

You acknowledge that this Privacy Policy is part of our User Agreement, and by accessing and using the Site you agree to be bound by all of its terms and conditions. This is to notify you as to what Personally Identifiable Information about you is collected, what organization is collecting the information, how the information is used, with whom the information is shared, what choices are available to you regarding collection, use and distribution of the information, what kind of security procedures are in place to protect the loss, misuse or alteration of information under our control, and how you can correct any inaccuracies in the information.

We collect two types of information: Personally Identifiable Information and Non-Personally Identifiable Information. You can choose not to provide certain information, but then you might not be able to take advantage of certain features of the Site. We use the information that you provide for providing you with a smooth, efficient and customized experience when using the Site.

A. Personally Identifiable Information. When you engage in certain activities on the Site, such as purchasing items, registering for contests and other promotional opportunities provided by the Site, filling out a survey, or sending us feedback, we may ask you to fill out and submit an online form to provide certain information about yourself, such as your name, mailing address (including zip code), email address, telephone and facsimile numbers and other personally identifying information. It is completely optional for you to participate in these activities. When ordering products and services on the Site, you may be asked to provide a credit card number. Depending upon the activity, some of the information we ask you to provide is identified as mandatory and some as voluntary. If you do not provide the mandatory data with respect to a particular activity, you will not be able to engage in that activity.

B. Non-Personally Identifying Information. This refers to information that does not by itself specify a particular individual. This information is compiled and analyzed on both a personal and aggregated basis. It may include the Uniform Resource Locator (URL) you just came from, which URL you go to next, what browser you are using, and your Internet Protocol (IP) address. The URL is the global address of documents and other resources on the World Wide Web. The IP is a number that is automatically assigned to your computer whenever you are surfing the Web. Web servers (the computers that serve web pages) automatically identify your computer by its IP address, and when you request a page from the Site, our servers log your IP address. The Site collects IP addresses for the purposes of system administration and to provide aggregate data to advertiser about the volume of use on the Site.

To fully use our services, you will need to register using our online registration form, where you will be required to provide us with your contact information and other personal information as described in our privacy appendix. You may provide us with a User ID - if you don't, we will use your email address as your User ID. Under some circumstances, such as if you are registering using an email account at a free email service, we require some additional information, including billing address and credit card information. We use this credit card information to verify your name, address, and other information.

In addition, we use cookies on certain pages of the Site. We may also offer certain features that are only available through the use of a cookie. Among other reasons why we use cookies, cookies allow you to enter your password less frequently during a session. Cookies can also help us provide information that is targeted to your interests. A cookie is a small data text file, which is stored on your hard drive, not on the Site. Most cookies are "session cookies," meaning that they are automatically deleted at the end of a session. You may occasionally get cookies from our advertisers, which is standard in the Internet industry. The Site does not control these cookies, and these cookies are not subject to Site's privacy policies. Most browsers are initially set to accept cookies. If you'd prefer, you can set yours to refuse cookies or to alert you when cookies are being sent. However, it is possible that some parts of the Site will not function properly if you do and you may be required to reenter your password more frequently during a session.

If you choose to purchase on the Site, we collect information about your buying behavior. If you choose to post messages in our chat rooms or leave feedback in other message areas, we will collect such information about you as you choose to disclose. If you send us personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the Site, we may collect such information into a file specific to you.

We use Personally Identifiable Information about you to improve our marketing and promotional efforts, to statistically analyze Site usage, to improve our content and product offerings and to customize the Site's content, layout, and services. We believe these uses allow us to improve the Site and better tailor it to meet our users' needs.

We may also use your information to deliver information to you that, in some cases, are targeted to your interests, such as targeted banners, new services and promotions. By accepting the User Agreement you expressly agree to receive this information. We use your email address, your mailing address, and phone number to contact you regarding administrative notices, new product offerings, and communications relevant to your use of the Site.

We use information in the file we maintain about you, and other information we obtain from your current and past activities on the Site, to resolve disputes, troubleshoot problems and enforce our User Agreement. At times, we may look across multiple users to identify problems or resolve disputes, and in particular on rare occasions, we may evaluate your information to look for users using multiple User IDs or aliases.

We do not sell, trade or rent your Personally Identifiable Information to others. We do provide some of our services through contractual arrangements with affiliates, services providers, partners and other third parties. We and our service partners use your Personally Identifiable Information to operate our sites and to deliver their services. For example, we must release your credit card information to the card-issuing bank to confirm payment for products and services purchased on the Site; release your address information to the delivery service to deliver products that you ordered; and provide order information to third parties that help us provide customer service.

We will encourage our service partners to adopt and post privacy policies. However, the use of your Personally Identifiable Information by our service partners is governed by the privacy policies of those service partners, and is not subject to our control.

It is important to note that the Site contains links to sites other than its own, and that those sites may not follow the same privacy policies as the Site. This can include links from advertisers, content providers and partners who may use the Site logo and/or style as a result of a co-branding agreement. These sites may send their own cookies to you, and may collect data and make uses of it that the Site would not. We cannot control this collection of information. You should contact these advertisers directly if you have any questions about their use of the information that they collect.

Occasionally we may be required by law enforcement or judicial authorities to provide Personally Identifiable Information to the appropriate governmental authorities. We will disclose this information upon receipt of a court order, subpoena or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful.

The following describes some of the ways your Personally Identifiable Information may be disclosed:

Advertisers. We do aggregate Personally Identifiable Information and disclose such information in aggregate to advertisers or for other marketing and promotional purposes. However, we do not disclose to these entities any information that could be used to personally identify you. Certain information, such as your password and credit card number are not disclosed to marketing advertisers in aggregate at all.

Co-Brand Service Providers. The Site offers third party services from the website. If you choose to use these optional services, we will, by necessity, provide some of your Personally Identifiable Information to the Co-Brand Service Provider offering such services. You can, of course, avoid having us make such disclosures by choosing not to use these services. Because we do not control the privacy practices of these third parties, you should evaluate their practices before deciding to use their services.

Suppliers and Other Service Providers. We may use third party Suppliers and Service Providers to facilitate our services. For example, we may outsource the operations of one or more aspects of the Site to a Supplier or Service Provider who performs services according to our requirements. In some instances, the Service Provider may collect information directly from you (such as the situation where we ask a Service Provider to conduct a survey for us). In these cases, you will be notified of the involvement of the Supplier or Service Provider, and all information disclosures you make will be strictly optional. In all cases, we restrict how these Suppliers and Other Service Providers may access, use and disclose your information. In general, we do not permit these Suppliers and Other Service Providers to sell your information to third parties.

The information you may change includes your email address, your User ID, your name, company, address, city, state, zip code, primary phone number and password. Upon your request, we will make the necessary corrections to your account. However, we will retain in our files information you have requested to remove in some circumstances, such as to resolve disputes, troubleshoot problems and enforce our User Agreement. Further, such prior information is never completely removed from our databases due to technical constraints and the fact that we back up our systems. Therefore, you should not expect that all of your Personally Identifiable Information will be completely removed from our databases in response to your requests.

At the Site, you can be assured that your Personally Identifiable Information is secure, consistent with current industry standards. The importance of security for all Personally Identifiable Information is of utmost concern to us. Your Personally Identifiable Information is protected in several ways. Access by you to your Personally Identifiable Information is available through a password and unique User ID selected by you. The password is encrypted. We recommend that you do not divulge your password to anyone. In addition, your Personally Identifiable Information resides on a secure server that only selected Site personnel and contractors have access to via password. We encrypt your Personally Identifiable Information and thereby prevent unauthorized parties from viewing such information when it is transmitted to us. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Personally Identifiable Information, you acknowledge that: (a) there are security and privacy limitations of the Internet which are beyond our control; (b) the security, integrity and privacy of any and all information and data exchanged between you and us though the Site cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

The Site encourages parents and guardians to spend time with their children online, and to be fully familiar with the sites visited by their children. No information should be submitted to or posted on the Site by users under the age of 13 without the consent of their parent or guardian. The Site does not provide any Personally Identifiable Information for users under the age of 13 regardless of its source, to any third party for any purpose whatsoever unless disclosed during collection. Users under age 13 are generally asked not to participate in contests or other promotional opportunities.

The Site requests that children under the age of 18 do not submit or post information to the Site without consent of parent or guardian. The Site may collect information, including Personally Identifiable Information, from users between the ages of 13 and 17, and with the permission of their parent or guardian, this information may be used in marketing and promotional purposes by the Site and may be shared with third parties. If a user or their parent or guardian changes their mind with respect to such use, such user, parent or guardian may stop that use by email request.

You should also be aware that when Personally Identifiable Information is voluntarily disclosed (i.e., your name, email address, etc.) in the discussion forums or other public areas on the Site, that information, along with any information disclosed in your communication, can be collected and used by third parties and may result in unsolicited messages from third parties. Such activities are beyond our control and this Policy does not apply to such information. Any submissions to chat rooms or other public areas on the Site are accepted with the understanding that they are accessible to all third parties. If you do not want your comments to be viewed by third parties, you are advised not to make any submissions. Ultimately, you are solely responsible for maintaining the secrecy of your password and/or account information. Please be careful and responsible whenever you are online.
